القاعدة الفقهية "لا ضرر ولا ضرار" وبعض فروعها وأحکامها في فقه العمران

هذا البحث الضوء علي قاعدة فقهية هامة لها دور کبير في الأحکام الصادرة عن فقه العمران، فدراسة القاعدة الفقهية يعين علي حفظ وضبط المسائل الکثيرة، بحيث تکون القاعدة وسيلة لاستحضار الأحکام، ويظهر لنا الدور الکبير للقاعدة الفقهية "لا ضرر ولا ضرار"، والتي تعد واحدة من القواعد الفقهية الخمس الأساسية الکبرى، التي أرجع بعض الفقهاء إلي هذه القواعد الخمس کل مسائل الفقه، من خلال تأثيرها علي شکل ومواضع التکوينات المادية للعمارة الإسلامية بالمدينة، وقد تفرع عن هذه القاعدة عدة قواعد أخري تخص کل منها جانب من جوانب الضرر، تجتمع تحتها المسائل المتشابهة، وبالرغم من ثبات القاعد الرئيسة، إلا أن القواعد المتفرعة عنها قد تختلف من مذهب فقهي لآخر، ويهدف هذا البحث لبيان دور هذه القاعدة في فقه العمران، والقواعد الفقهية المتفرعة عنها والتي تهتم کل منها بجزئية محددة، کالوقاية من وقوع الضرر، ونزع الضرر، وتقنين بعض أوضاع الضرر، والتعويض عن الضرر، والشخص أو الجهة المکلفة بإزالة الضرر.
This research sheds light on an important jurisprudence rule that has a great role in the rulings issued by the jurisprudence of urbanism, The study of the jurisprudential rule helps me to preserve and control the many issues, so that the rule is a way to evoke rulings, to show us the great role of the rule of jurisprudence "No Harm (La Dārar)", which is one of the five major rules of jurisprudence, Some scholars attributed to these five rules all issues of jurisprudence, Through its influence on the shape and location of the physical formations of Islamic architecture in the city, and has been divided from this rule several other rules pertaining to each One of them is an aspect of harm, and similar issues are gathered under it Stability of the main rule, but the rules deriving from them may differ from the doctrine of jurisprudence to another, and this research aims to show the role of this rule in the jurisprudence of urbanism, and the rules of jurisprudence, which are concerned with each specific part, such as the prevention of harm, Remove the harm, Legalize certain harm situations, Compensation for the harm, and the person or entity charged with the removal of the harm.
