للمستشرقین دراساتهم في السنة النبوية والفقه الإسلامي , ودراسة السنة والفقه تعطي المستشرقین الفرصة لفهم أعمق للمجتمعات الإسلامیة قدیما وحدیثا ، وتخصص بعض المستشرقین في دراسة السنة النبوية والفقه الإسلامي باعتبارهما تطبیقًا حقیقیا للفكر الإسلامي العام ، فبحثوا في أصولهما وفروعهما وتاریخهما وتطورهما ومراكزهما ومذاهبهما وتأثیرهما , ومن هنا جاءت جل الكتابات الاستشراقیة في مجال السنة النبوية والفقه الإسلامي منطلقة من الاعتقاد الذي ینفي عنهما أصالتهما .
